Proposed resolution proclaiming O'Fallon as a "Rule of Law" city and expressing the policy of the City regarding  compliance with immigration laws. 
Background:
This resolution was discussed with the City Council at the August 25 workshop.  The resolution declares O'Fallon to be a "Rule of Law" city with the intent of enforcing immigration laws.  The resolution also affirms the City's intentions to adhere to several provisions in Missouri State Statute regarding immigration matters.  Specifically the City:
  • Is not a sanctuary city and has no intention of becoming a sanctuary city;
  • Will not hinder or restrict employee communication with federal officials regarding the immigration status of individuals;
  • Provide written notice to current and future Police Officers to cooperate with State and Federal officials regarding the enforcement of immigration laws;
  • Will not provide public benefits to aliens unlawfully present;
  • Will enroll and participate in a federal work authorization program;
  • Will require any contract greater than $5,0000 require the business to participate in a federal work authorization program.

Previous Council Action:
This topic was introduced to the City Council by Council member Pepper at the August 11 workshop. Following the discussion at the August 25 workshop, the City Council requested this resolution be brought forward for consideration.
Recommendation:

This resolution is being presented for Council consideration.  Staff recommends adoption of the resolution as presented.

The proposed resolution outlines the City's policy regarding the enforcement of immigration laws.  The resolution does not create any additional requirements for the City and therefore does not have a fiscal impact.
